Using this website or any VanillaGreen product means you accept these terms. If you do not accept them, do not use them. If you are agreeing on behalf of a company, you confirm you are allowed to bind it.

kendex and VanillaGreen Shell are published under the MIT license, included in their repositories. hyprtrade, memsira, and drovr are in development and each ships with its own license.

Where a product includes a license file, that license governs the software itself. These terms govern everything around it: this website, downloads, and any service we operate. If the two conflict about the software, the product license wins.

You may read, link to, and quote this website for personal and internal business use. You may not republish its design, text, or code as your own. The VanillaGreen name and wordmark belong to VanillaGreen LLC.

You agree not to:

• use the website or products for anything unlawful;
• probe, scan, or attempt to gain unauthorised access to our systems, or disrupt them;
• scrape or automate against the site in a way that degrades it for other people;
• use the contact form for bulk, unsolicited, or automated messages;
• remove or obscure copyright or license notices.

You keep ownership of anything you send us. You give us permission to read it, store it, and reply to it. Do not send confidential information, trade secrets, or anything you are not free to share: a message sent through this website is not covered by a non-disclosure agreement.

Our products can connect to services we do not operate — package registries, model providers, market data feeds, and others. Those services have their own terms and their own privacy practices, and we are not responsible for them.

hyprtrade is software, not financial advice. Nothing we publish is a recommendation to buy or sell any instrument, and no output of any VanillaGreen product should be treated as one. Trading carries real risk of loss and every decision you make with our software is your own.

THE WEBSITE AND THE SOFTWARE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, VANILLAGREEN LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE OR THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECT WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VANILLAGREEN LLC IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR TRADING LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE WEBSITE OR THE SOFTWARE. OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE PRODUCT IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED US DOLLARS (USD 100).

Some jurisdictions do not allow limits like these. Where that is the case, they apply to the fullest extent the law permits.

You agree to cover VanillaGreen LLC against claims, losses, and reasonable legal costs arising from your misuse of the website or the software, or from your breach of these terms or of the law.

We may change, suspend, or discontinue any product or any part of this website. When these terms change we update the date at the top of the page; continuing to use the website or the software after that means you accept the new terms.

We may suspend your access to this website or to any service we operate if you break these terms. Rights already granted to you under an open-source license are not revoked by that suspension.

These terms are governed by the laws of Washington State, USA, without regard to its conflict-of-laws rules. Any dispute arising from them or from your use of the website or the software belongs in the state or federal courts located in Washington State, and you consent to the jurisdiction of those courts.

If any provision of these terms is held unenforceable, the rest stays in force. These terms, together with any applicable product license, are the entire agreement between us about their subject.
